PT Bank Neo Commerce Tbk (“BNC”) fully understands that protecting the personal information or data of each user of the Neobank Mobile Banking application of BNC (the “Application”) and/or the BNC’s website (www.bankneocommerce.co.id) (the “Website”) and being transparent about what we do with this personal information or data is one part of building user’s trust in us.

 

BNC is committed to protecting user’s personal information or data. If BNC asks user to provide certain personal information or data to identify user when using the Application and/or the Website, it can be ascertained that such personal information or data will only be used in accordance with this Privacy Policy. The user’s personal information or data possessed by BNC is a bank secrecy that must be protected by BNC in which the exception will refer to the applicable laws and regulations.

 

This Privacy Policy explains how BNC uses and protects all personal information or data provided by user to BNC while using the Application and/or the Website. Therefore, it is hoped that user can read this Privacy Policy thoroughly to ensure that user understands our data processing practices.

 

This Privacy Policy Covers the Following:

 

I. Information that We Collect

 

This Privacy Policy is intended for all personal information or data of each user that BNC collects and uses when the user uses the Application and/or the Website, including, but not limited to:

  1. Personal data in the form of user information, including, but not limited to, name, address, phone number, email address, date of birth, occupation whether listed on the identity card or other media where the information can be obtained and other personal data contained in the correspondence between user and BNC via email or physical mail;
  2. Specimen signature;
  3. Financial details in the form of financial and/or banking transactions data;
  4. Tax and insurance information;
  5. Images and recordings of user conversations with BNC’s employees;
  6. Information on risk profiles, investments and other data relating to business interests and assets;
  7. The information contained in the correspondence between user and BNC via email or physical mail;
  8. Information contained in the user’s decision along with the consent if the user decides to apply for BNC services or products through the Application and / or Website; and
  9. Personal opinion in the form of feedback or responses to the survey notified to BNC.

 

Failure to provide such data may result in BNC being unable to provide its services to user.

 

II. Storage of Personal Information

 

BNC will store the personal information or data of the user for archive purposes in accordance with policies applicable at BNC from time to time.

 

To the extent permitted by the prevailing laws and regulations, BNC will continue to store the personal information or data of user collected by BNC, unless there is a written request from the user to end the processing, delete and/or destroy the personal information or data of the user. In such case, BNC will end the processing, delete and/or destroy the personal information or data of the user in accordance with the policy applicable at BNC from time to time.

 

III. Biometric Data

 

In addition to the personal information or data of the user as mentioned in Section I above, BNC will also collect and use the biometric data provided by the user voluntarily, which is data related to physical, physiological, or individual behavioral characteristics, which enable unique identification of individuals, including, but not limited to, face images (“Biometric Data”).

 

As a banking institution, BNC has an obligation to carry out a know-your-customer (“KYC”) process, whereby BNC will verify the Biometric Data of the user with the data owned by the Population and Civil Registration Agency and/or certification authorities certified by the government of the Republic of Indonesia through electronic system. After the verification is successfully conducted, BNC will store the Biometric Data as evidence of the KYC process, and the Biometric Data of the user will be used as reference in the implementation of transactional banking services by user which require 2 (two) authentication factors as required based on the prevailing laws and regulations.

 

IV. Storage of Biometric Data

 

In storing the Biometric Data of user, BNC will store the Biometric Data for as long as the user is registered as a customer of BNC and uses the banking services provided on the Application and/or Website. In the event the user is no longer registered as a customer of BNC due to account closing or otherwise, BNC will store the Biometric Data of user for a maximum retention period of 10 (ten) years or for a shorter period if stipulated by the laws and regulations in effect from time to time.

 

V. The use of Personal Information

 

BNC is the sole owner of all personal information or data collected from the Application and/or the Website. BNC will not sell, exchange, share or show user’s personal information or data to other parties for purposes that are not stated in the terms and conditions that have been agreed upon when BNC is in relationship with the user and its changes from time to time according to notification to the user. BNC will always endeavor to maintain the security of user’s personal information or data and protect it against manipulation, forgery, irresponsible access and disclosure.

 

BNC may use collected user’s personal information or data for the following purposes as well as for other purposes as permitted by applicable laws and regulations:

 

  1. BNC may use personal information or data for business purposes, such as developing and providing banking facilities, products or services, including but not limited to assisting BNC in analyzing how BNC services are used or for professional advisors and BNC’s external auditors, including legal advisors, financial advisors, and consultants, BNC’s affiliated companies, subsidiaries, parent companies, and related companies in connection with BNC’s business operations, as well as other people or companies that are under a duty of confidentiality to BNC as well as reporting to regulators and further investigation by parties authorized and in accordance with applicable laws in Indonesia, etc., which are regulated i n accordance with BNC internal policies and procedures or in accordance with the terms and conditions governing the relation between BNC and user. In this regard, BNC will use the best efforts to get the related parties as mentioned to respect this Privacy Policy.
  2. BNC may use user’s personal information or data for marketing purposes, i.e. to offer products or services, including special offers, promotions, contests or information that may be of interest to the user. Those marketing messages can be sent to user in a variety of ways including but not limited to physical mail, electronic mail, short message services, telephone, facsimile and other information delivery media in accordance with and subject to Bank Indonesia/Financial Services Authority regulations and other regulations applicable in Indonesia. User can make a request to BNC if user wants to stop being contacted by BNC for that marketing purposes by contacting the BNC call center as stated in this Privacy Policy.
  3. To fulfill the 2 (two) authentication factors requirement as required by the prevailing laws and regulations, BNC will send the biometric data of user to the Population and Civil Registration Agency and/or certification authorities certified by the government of the Republic of Indonesia for the purpose of authenticating user data in the form of face match authentication, and as a risk mitigation effort of BNC.

 

However, BNC will disclose user’s personal information or data as long as necessary to protect and prevent fraud, claims, and other obligations in the event of a dispute or any form of legal process between the user and BNC, or between the user and other parties in connection with, or related to services on the Application and/or the Website, or in emergencies relating to the health and/or safety of user while remain subject to applicable laws and regulations.

 

VI. Cookie Policy

 

Every time user uses or visits the Application and/or the Website, certain information can be collected automatically using cookies from the online registration form that has been filled in by the user. Cookies are small application files that are stored on a computer or mobile device when a user visits a website or uses an application. BNC uses cookies to provide personalized services, including, but not limited to, relevant login and authentication details as well as information relating to user activities and preferences on the Application and/or the Website.

 

Cookies collect information about user and use r’s visit to the Application and/or the Website, such as Internet Protocol (IP) address, how to be connected with the Website (for example, via search engines or links from other websites) and how to navigate the Application and/or the Website. Information from these cookies helps BNC collecting visitor statistical information to improve the services of the Application and/or the Website. Some cookies are temporary and will disappear when the user closes the Application and/or the Website, while some cookies will persist and will remain on the user’s computer or mobile device for some time.

 

Most mobile devices and internet browsers on computer support the use of cookies, but the user can adjust the settings on the user’s mobile device or internet browser to reject certain types of cookies. The user’s mobile device and/or internet browser also allow the user to delete any cookies that were previously stored. However, it may affect the functions available on the Application and/or the Website.

 

VII. Personal Data Security

 

BNC is committed to ensuring user’s personal information or data obtained through the Application and/or the Website remains safe. In implementing this commitment, BNC has applied procedures and used an electronic system that is equipped with an adequate level of security as required by applicable legal provisions and BNC will update the level of security from time to time.

 

To ensure protection for user in accessing the Application and/or the Website, please do the following:

1. In case of user accessing the Website, please ensure that the address you have accessed is correct, namely www.bankneocommerce.co.id;

2. In case of user accessing the Application, BNC requires user to:

a. enter the User ID and Login Password/PIN before user can access the Application;
b. maintain the confidentiality of User ID and Password/PIN Login and do not disclose them to anyone;
c. to contact BNC in case the user forgets the Password/Login PIN or the user’s Login Password/PIN is blocked. Follow the BNC’s instructions on how to activate the user application again.
 
 
 
 
 
 
As permitted under applicable legal provisions, user has the right to request that their personal information or data to be deleted from the BNC database by submitting an official request to BNC contacts as referred to in section 8 of this Privacy Policy. However, as a consequence, user can no longer access the Application and / or Website as it should be.

 

VIII. Changes of Privacy Policy

 

BNC may change this Privacy Policy at its own BNC’s policy from time to time, to adjust the developments of the situation and/or changes in applicable legal requirements by updating this page without prior notification. User of the Application and/or the Website are expected to review this Privacy Policy carefully from time to time to ensure that user is aware of any changes made to the latest information regarding data processing and data protection practices at BNC. Any activity that is carried out through the Application and/or the Website must be subject to the most recent version of this Privacy Policy. By continuing to access and use the services available in the Application and/or the Website, the user is deemed to have agreed to the changes of the Privacy Policy from time to time.

 

IX. Acknowledgment and Consent

 

By using the Application and/or the Website, user acknowledges that user has read, understood and agreed to this Privacy Policy along with all terms of use, practice, processing and transfer of user’s personal information or data by BNC as stated in this Privacy Policy. The user also states that the user is the sole right owner to share all information the user has provided to BNC and to give BNC the right to use the information in accordance with applicable law.

 

X. Third Party Sites

 

In using the Website, user may find links to other sites that are owned by third parties and which are outside the control of BNC. If user visits the link through the Website, BNC encourages user to read and understand the privacy policy of the link because BNC is not responsible for that link and this Privacy Policy does not apply to the site resulting from the link.
